1. AREA OF APPLICATION
MODADO GmbH with registered office in Wallisellen (hereinafter MODADO) is an online dealership in fashion and accessories with a sense for design, quality and sustainability. These terms and conditions shall apply to all orders placed on the website http://www.modado.ch. The parties shall only be bound by the terms & conditions which are online the day the order is placed.

2. ORDERS AND CONTRACT CONCLUSION
Online orders are placed in the shop. The order is binding when the terms and conditions have been agreed to and the BUY-button has been pushed. Through this a completed and legally binding sales contract is concluded. After receiving your order an e-mail confirming the order will be sent to you.

3. DELIVERY AND SALE CONDITIONS
After the order confirmation, we will send the ordered articles to the address declared by you in a nice package. The usual delivery time with economy shipping is 3-5 workdays and with priority 1-2 workdays.

For orders from abroad delivery time can be up to 14 workdays longer. Should delivery not be possible after several tries, MODADO can withdraw from the contract.

4. OFFER
Our online offer is subject to change and non-binding. In general the articles offered in the online shop are available. Should it not be possible to deliver one or more articles due to stock variation MODADO will inform you about the circumstances as quick as possible and offer you comparable articles. If none of these appeal to you, the amount due will be reimbursed.

5. PRICES
Our retail prices are calculated ex-stock and are stated in Swiss Francs (CHF) including legal value-added tax and excluding shipping charges. The prices in the online shop can be converted in any currency as a guidance with the currency converter. Please note that the rate showed is just an indication.

6. YOUR PURCHASE ACCOUNT
For orders from our online shop possible payment methods are indicated there. With the first purchase on invoice –positive credit assessment provided- we will open a purchasing account for you through which all purchases, payments and vouchers will then be processed.

For orders from abroad delivery time within Europe 3-4 workdays and for the United States of America 4-5 workdays. Should delivery not be possible after several tries, MODADO can withdraw from the contract.

8. PAYMENT METHODS
For orders in Switzerland or the Principality of Liechtenstein the following payment methods are available: credit card and PayPal. Orders from abroad can be paid by credit card and PayPal.

8.1. CREDIT CARD
Orders can be paid by credit card (VISA or MasterCard) through the safe payment system SAFERPAY (SIX MULTIPAY). Possible fees from the credit card company may be charged to you.

8.2. PAYMENT DEFAULT
in case of payment default we are entitled to charge a default interest of 10% a year plus a surcharge of CHF 10.00 after the 2. Dunning letter. Dunning letters and invoices will be sent to you by e-mail. In case of payment default MODADO is entitled to assign the claim and incurring costs of the debtor to third parties. The right to claim further compensation remains reserved.

9. PROMOTIONAL VOUCHERS
Promotional vouchers are vouchers, which cannot be purchased, but which we issue in connection with advertising campaigns. Promotional vouchers are only redeemable under the terms and conditions referred therein, from the respective recipient, in the specified period and only once per person. Individual products may be excluded from the voucher promotions.

Promotional vouchers are linked to a minimum order value of CHF 30; The value of goods must, in any case, be at least equal to the amount of the voucher. The difference to a higher value of the goods is to be offset with the offered possibilities of payment. Promotional vouchers are neither paid out in cash, nor do they accrue interest.

Reimbursements of promotional vouchers for the partial or total return of the ordered products is excluded. Promotional vouchers can only be redeemed prior to the completion of the ordering process. Subsequent crediting is not possible. The promotional voucher is not transferable and may not be combined with other promotional vouchers. Should you have used a promotional voucher for your purchase, we reserve the right to charge you the original price of the goods, which you have retained, if – due to your cancellation- the total value of the order falls below the value of the promotional voucher.

10. RETENTION OF TITLE
The ordered products remain property of MODADO until they have been fully paid for.

11. REVOCATION RIGHT/RIGHT OF RETURN
You have the right to withdraw from the contract within 10 days after receiving the merchandise, through returning the merchandise with a reason for return. Returning the merchandise is to your responsibility and costs.

The articles must be returned in the original unglued and undamaged packaging. Only immaculate, completely intact and unworn articles will be taken back. Particularly worn, dirty, damaged or badly smelling products can’t be taken back. If this is not the case, we reserve the right to assert compensation claims.

The value of the returned article can be deducted from the total amount due. If the total amount has already been transferred to MODADO, you can choose between a cash or voucher reimbursement. Shipping costs will not be refunded.

12. DELIVERY DEFECTS
We ask you to examine the correctness, completeness and intactness of received articles. Complaints regarding the scope of delivery, material defects, incorrect delivery and quantity deviations are to be reported to us within 5 working days after receipt, per letter. Shortcomings will be examined by MODADO immediately, If MODADO accepts the shortcoming, and the article is still in stock, you will receive a replacement and shipping costs will be reimbursed. Otherwise the full amount will be reimbursed.

13. WARRANTY
Warranty of purchased articles is limited to the warranties of the respective producers. Claims cease to exist if there is improper handling or personal intervention.

14. PRIVACY
Protecting your personal data is very important to us. We follow the applicable data protection regulations and secure your data against unauthorised access of a third party (data security precautions).

Our online shop is encrypted through SSL (Secure Socket Layer), which safely transfers all data concerning the supply as well as your payment and personal data to us. MODADO is authorised to use your personal data to provide you with special offers or information about our new collection. You can revoke your consent to the use of your personal data for commercial purpose anytime by writing an e-mail to info@modado.ch. Using technological and organisational measures we secure our website and other systems against loss, deletion, access, change and distribution of your data through unauthorised people. Access to your purchasing account is only possible after entering your personal password.

15. APPICABLE LAW AND AREA OF JURISDICTION
The contractual relationship between you and MODADO shall be governed by Swiss material law under exclusion of the UN convention on the International Sale of Goods of 11.April 1980 (UN sales law). Area of jurisdiction for all disputes is Wallisellen, Zürich, Switzerland. MODADO is further authorised to electively call upon the court at the seat/domicile of the customer.
